Terms of Service

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding contract. The Service is intended for use by individuals; commercial resellers are not permitted to purchase on behalf of third parties without our written consent.

To purchase digital products you will need to create an account using either Discord OAuth, Google, Microsoft, or a verified email address. You are responsible for safeguarding the credentials associated with your account, including any session cookies, two-factor authentication codes, and backup codes. You are responsible for all activity that occurs under your account, whether or not you authorized it. Notify us immediately if you suspect unauthorized access by opening a ticket at /support, in the Esko Kustomz Discord server, or by emailing eskokustomz@gmail.com.

Each purchase grants you a non-exclusive, non-transferable, non-sublicensable, perpetual license to use the purchased vehicle file ("Product") solely on FiveM servers that you personally own, lease, or operate. The license is per-user. You may install the Product on multiple servers under your control, but you may not transfer the license to another person, account, or organization.

The license expressly does not include the right to:

• Resell, re-license, lease, or sublicense the Product to any third party.
• Distribute, share, upload, or make the Product available on any platform, repository, leak site, marketplace, or community space.
• Repackage, rebrand, or claim the Product as your own work.
• Use the Product, in whole or in part, as the basis for a derivative work that you then distribute.
• Reverse-engineer, decompile, or extract the Product's source assets for redistribution.

A breach of any of the above terminates the license immediately, without refund.

All vehicle files, model assets, textures, sounds, handling configurations, branding, logos, copy, and original content on the Service are the intellectual property of Esko Kustomz or its licensors and are protected by copyright, trademark, and other applicable laws. The license described above conveys no ownership interest. We retain all rights not expressly granted.

If you believe content on the Service infringes your copyright, send a takedown notice to eskokustomz@gmail.com with: a description of the work, the location of the allegedly infringing content, your contact details, a good-faith statement that the use is not authorized, a statement under penalty of perjury that your notice is accurate, and your physical or electronic signature.

All prices are listed in U.S. dollars and are exclusive of any taxes that may apply in your jurisdiction. Payment is processed by Paddle; we do not see, store, or transmit your card details. By placing an order, you authorize us (via Paddle) to charge the payment method you provide for the full amount of the order, including any applicable taxes.

Prices and product availability are subject to change without notice. Promotional discounts and bundle pricing are valid only for the period and conditions stated at the time of purchase.

Every Product is a digital file delivered instantly to your account on completed payment. Because nothing ships physically and nothing can be returned, all sales are final and no refunds are issued. By placing an order you confirm that you understand and accept this policy.

Every file in the shop is tested end-to-end before it goes on sale: spawn name, model integrity, handling, sounds where included, and drag-and-drop install on the latest FiveM artifact. Specs, included extras, file size, and lore-versus-non-lore classification are listed on each product page so you can verify fit before you buy.

Buyer responsibility

It is the buyer's responsibility to confirm, before purchase, that the Product is compatible with their intended server. We do not refund a purchase because of any of the following, all of which are within your control to check first:

• The server you play on enforces a poly-count budget below the file's size, and the file gets rejected on stream.
• The server only allows lore-friendly / TOS-safe vehicles, and you bought a non-lore vehicle (or vice-versa). Each product page clearly labels its line.
• The server uses a framework, vehicle-shop resource, or anti-cheat that you didn't account for.
• You changed your mind, picked the wrong car, or no longer want the file after downloading it.
• The file works fine on your local test server but the operator of someone else's server declines to add it.
• Your purchase was on the wrong account, or you forgot you already owned the file.

Genuinely defective files

If a Product is genuinely broken (the download link is permanently unreachable, the archive will not extract on multiple systems, or the file substantively differs from the listing), open a ticket within 14 days of purchase. We will investigate and, when the issue is on our end, replace the file. Replacement is the sole remedy in those cases; cash refunds are not issued.

Chargebacks

Filing a chargeback or payment dispute on a successfully delivered Product without first opening a support ticket is treated as fraud. Doing so results in immediate account termination, revocation of any associated Discord roles, and may be reported to your payment processor and to law enforcement.

To raise a defect concern or any other support matter, open a ticket in the Esko Kustomz Discord server or use the on-site ticket system at /support. Email is available at eskokustomz@gmail.com if you need a paper trail or can't access Discord.

Some Products include automatic Discord role grants on the Esko Kustomz community server. By using this feature you authorize us to add and remove roles on your linked Discord account based on your purchase history and lifetime spend tier. Roles may be revoked if you receive a refund, your purchase is reversed, or your account is terminated for cause.

To receive role grants you must be a member of the Esko Kustomz Discord server with your Discord account linked to your Esko Kustomz account. Discord is a third-party service governed by its own terms, which we do not control.

You agree not to use the Service to:

• Engage in fraud, including filing false chargebacks or using stolen payment information.
• Attempt to access another user's account, order, or download links.
• Probe, scan, or test the security of the Service or attempt to bypass any access control, rate limit, or content protection.
• Interfere with the Service's normal operation through denial of service, scraping, or automated abuse.
• Upload, transmit, or share any content through our support channels that is illegal, harassing, defamatory, or violates the rights of others.
• Use the Service in any way that violates applicable law in your jurisdiction or the jurisdictions where the Service operates.

We may suspend or terminate your account, revoke your license, and remove access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud, abused our staff or community, or for any other reason in our sole discretion. Upon termination, your right to use the Service ends immediately, but the obligations described under Intellectual property, License grant, Limitation of liability, and Indemnification survive.

You may terminate your account at any time by using the Delete my account section under /account/security. The deletion is self-serve and immediate. If you can't access your account, open a ticket in our Discord server, use the on-site ticket system at /support, or email eskokustomz@gmail.com. Account termination does not entitle you to a refund of past purchases.

The Service and the Products are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

We do not warrant that any Product will be compatible with every FiveM build, framework, or third-party resource, and we make no guarantee about the performance impact of any Product on your server. You are responsible for testing each Product in your own environment before deploying it to production.

To the maximum extent permitted by law, in no event will Esko Kustomz, its operators, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for lost profits, lost revenue, lost data, business interruption, or loss of goodwill, arising out of or in connection with your use of the Service or any Product, regardless of the legal theory and even if we have been advised of the possibility of such damages.

In any case, our aggregate liability for any claim arising out of or relating to the Service or any Product will not exceed the greater of (a) the total amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) fifty U.S. dollars ($50.00).

You agree to defend, indemnify, and hold harmless Esko Kustomz from and against any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or related to your breach of these Terms, your violation of any law or third-party right, or your use or misuse of any Product, including any unauthorized redistribution.

We may modify or discontinue the Service, or any feature, Product, or pricing, at any time. We may also update these Terms from time to time. Material changes will be announced on the Esko Kustomz Discord server and via email if you have an active account. Your continued use of the Service after a change constitutes acceptance of the updated Terms. The "Last updated" date at the top of this document reflects the most recent revision.

These Terms are governed by the laws of the United States and the State in which Esko Kustomz is operated, without regard to conflict-of-law principles. You agree that any dispute arising out of or related to these Terms or the Service will be resolved exclusively through binding individual arbitration or in the small-claims courts of that jurisdiction. You waive any right to a jury trial and to participate in any class action.

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
